IMO Wash Club App Terms and Conditions

 

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY REGISTERING WITH THE WASH CLUB, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.


These Terms and Conditions, together with the IMO Privacy Policy, apply to your membership of the Wash Club and govern the relationship between Anduff Car Wash Limited, a company incorporated in England with its registered office at 35-37 Amersham Hill, High Wycombe, Buckinghamshire, HP13 6NU ("IMO", "we" or "us") and you in relation to your membership of the Wash Club.

We reserve the right to change these Terms and Conditions or terminate the Wash Club Programme at any time at our sole discretion. In the event of a material change to these Terms and Conditions or termination of the Wash Club Programme, we will give at least one month's notice.

 

  1. Become a member

You can join the Wash Club by installing (free of charge) and registering with the IMO App available from the App Store or Play Store ("the App").

 

To be able to use the app properly and to its full extent, you should have a compatible device and an operating system that is as up-to-date as possible (iOS and Android). Regular updates of your devices may also be required. Use of the app also requires internet access. This may incur costs as part of the contract for the use of the mobile device. IMO is not liable for any costs arising from faulty data transmissions or damage to devices in connection with the use of the app.

 

  1. App membership

Your membership can only be registered in the name of an individual and only one membership can be registered in the name of an individual.

Membership via the app is only possible for people who:
    (i) are 17 years of age or older;
    (ii) are in possession of a full and valid driving licence valid for driving in the UK; and
    (iii) is a fully insured driver.

 

IMO employees, IMO site operators or their staff are not permitted to use the app.

You must not disclose your account or login details (such as your account ID and password) to anyone else. You must notify us immediately of any unauthorised access to your account.

 

  1. Loyalty stamps

With each completed wash from programme 3 (Triple Foam) or higher, you will receive one stamp when you scan the QR code on the app at the time of purchase. When you have collected three stamps, you will receive a voucher for £2 off an HD wash credited to your digital Wash Club Card in the app. When you have collected six stamps, your stamps will be converted into a digital voucher for a free Ultra HD wash at an IMO Car Wash in the UK in the app.

If you have not used the app to collect loyalty points in the last twelve months, any existing loyalty points that have not been converted into a free car wash will expire.

Each free car wash is valid for 30 days from the date of issue.

Only one stamp may be collected per day. No stamps will be awarded for redeemed car wash vouchers purchased as part of a multiple wash package.

 

  1. Pre-paid purchases

You can purchase car wash vouchers in advance on the app for single or multiple washes. The following conditions apply to all purchases of the washes via the app:

    (i) Prepaid washes are only valid at the location selected at the time of registration and for the vehicle registered in the app. 
    (ii) The washes can only be redeemed against the Triple Foam wash programme.
    (iii) All pre-paid washes not redeemed within the following periods from the date of purchase will be forfeited:

  1. General

There are no fees for Wash Club membership. All rewards issued through the Wash Club programme are non-transferable, have no cash value and cannot be exchanged for cash.

Only one reward can be redeemed per transaction unless otherwise stated and cannot be used in conjunction with any other offer or promotion.

Rewards are only valid at participating locations.

Prepaid vouchers, rewards and all discount vouchers require the display of a valid QR code to be used or redeemed. IMO reserves the right to refuse a payment or redemption with the App in individual cases if a payment or redemption is not possible due to a technical malfunction.

IMO shall not be liable for the use of the app by third parties, in the event of misuse or loss of the mobile end device. Misuse may occur in particular if the access data and the QR code displayed on it are not handled carefully so that unauthorised third parties misuse this information.

Tampered IMO Wash Club digital codes are invalid and will be immediately blocked without financial compensation.

 

  1. Termination of your membership

We may, at our discretion, cancel your membership (immediately and without notice) if you:

 

    (i) do not meet the requirements for Wash Club membership;
    (ii) are guilty of, or suspected by us of, any abusive behaviour (whether actual or threatened) towards our equipment or any of our operators or their employees, wherever located; or
    (iii) violate or are suspected of violating these Terms and Conditions or provide false information.

 

  1. Maintenance and Servicing of Equipment

To maintain the quality and availability of our sites, we are committed to regular maintenance and servicing of our washing facilities. During these times, the provision of services at our sites may be interrupted. We cannot guarantee that our machinery and equipment will be fully operational at all times and services at our sites may be interrupted from time to time.

 

  1. Your personal data

We apply strict security procedures to ensure that your personal data is not disclosed to third parties without your consent and we are committed to ensuring the security of your data in accordance with data protection laws.

  1. Liability

We do not exclude or limit our liability to you in any way if it would be unlawful to do so. 

If we fail to comply with these Terms and Conditions, we will not be responsible for any loss or damage that is not foreseeable. We will not be liable or responsible for any injury or incident (resulting in damage or loss to you or your vehicle) arising out of the improper use of our equipment unless caused by our negligence.

  1. Contact between us

If we need to contact you, we will do so in writing to the email address you provided to us when you registered. We will only contact you in accordance with our privacy policy.

 

  1. How we handle disputes

We will endeavour to resolve all disputes promptly and fairly. If you have a complaint about our services that cannot be resolved on the spot, please send us details of the dispute and your current contact details, either by email to [email protected] or by recorded delivery to the address shown on our website. We aim to respond to such letters within 5 working days.

 

  1. These General Terms and Conditions

We reserve the right to amend or waive any provision of these Terms and Conditions from time to time and at any time, or to terminate the Wash Club Programme (and therefore your membership) on reasonable notice. You should check the terms and conditions on our website from time to time to take note of any changes we make as they will be binding on you from the date we make them.

 

If a court decides that any part of these Terms and Conditions is invalid, that part will not apply, but the remainder of these Terms and Conditions will apply. Any delay in enforcing any provision of these Terms and Conditions shall not prevent the subsequent enforcement of that provision or the enforcement of any other provision of these Terms and Conditions.

 

These Terms shall be governed by English law. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation, unless you live in Scotland or Northern Ireland in which case you can choose to bring any claim arising out of these Terms and Conditions in your local court.
